On accessing and using the Site, you agree to be bound by the following Agreement without limitation or qualification; so please carefully review this Agreement before proceeding. If you do not intend to be legally bound by these terms and conditions, do not access and use the Site. ALMA DE MEXICO reserves the right to change this Agreement and to make changes to any of the products or programs described in the Site at any time without notice or liability.

Agreement

Any such revisions are prospectively binding on you and therefore you should periodically visit this page when you use the Site to review then the current Agreement that binds you. ALMA DE MEXICO also reserves the right at its sole and unfettered discretion to deny you access to the Site at any time. ALMA DE MEXICO enters into agreements with third parties from time to time to provide our customers with the opportunity to obtain special services, products or prices offered by the third party. You will not be deemed to be violating this agreement when acting in accordance with the terms and conditions of any such program. Likewise, the terms and conditions in this agreement will be considered broadened to the extent needed to permit such third parties to operate within the terms of a written agreement they have entered into with us.

The titles in this Agreement are provided only for your convenience and are not to be used in interpreting the Agreement.

• Unless otherwise noted, all ALMA DE MEXICO information, articles, data, images, passwords, Personal Identification Numbers ("PINs"), screens, text, user names, Web pages, or other materials (collectively "Content") appearing on the Site are the exclusive property of Aerolineas Mesoamericanas S.A. DE C.V. and/or ALMA DE MEXICO, or their subsidiaries and affiliates.


• All information, products, services and software contained on or used in the Site ("Content") is Copyright 2001 by ALMA DE MEXICO. All rights reserved. Please assume that everything you see or read on the Site is copyrighted to, or used with permission by, ALMA DE MEXICO unless otherwise noted.


• The trademarks, logos, service marks, and trade dress (collectively the "Trademarks") displayed on the Site are registered and unregistered Trademarks of ALMA DE MEXICO or others.


• Images of people, objects, or places displayed on the Site are either the property of, or used with permission by, ALMA DE MEXICO.


• ALMA DE MEXICO owns or uses with permission all software contained on the Site, including without limitation all HTML, ASP, PERL code and Active X controls. Copyright and other laws and international treaty provisions protect this software. The law expressly prohibits any modification, redistribution or reproduction of the software, and such actions could result in severe civil and criminal penalties. ALMA DE MEXICO will seek and support prosecuting violators to the maximum extent possible.


• You may not copy, display, distribute, download, license, modify, publish, re-post, reproduce, reuse, sell, transmit, use to create a derivative work, or otherwise use the content of the Site for public or commercial purposes. • ALMA DE MEXICO provides the Site solely to permit you to determine the availability of goods and services offered on the Site and to make legitimate reservations or otherwise transact business with ALMA DE MEXICO, and for no other purposes.


• The Site is for your personal, non-commercial use. You agree that you will use the Site's services only to make legitimate reservations or purchases for you or for another person for whom you are authorized to act both legally and under the terms of this Agreement. You agree that without limitation you shall not make any false reservation or any reservation in anticipation of demand.


• If ALMA DE MEXICO determines that you have confirmed multiple reservations to one or more destinations on or about the same date, ALMA DE MEXICO may without notice cancel all confirmed space associated with the multiple reservations.


• You agree to abide by the terms and conditions of purchase ALMA DE MEXICO imposes including, but not limited to, payment of all amounts when due and compliance with all rules regarding availability of fares, products, or services. You are completely responsible for all assessments, charges, duties, fees, and taxes arising out of your use of the Site. Your account information is owned by and proprietary to ALMA DE MEXICO.


• While you may access your account information through the Site, you may not give access to your account to any person or entity other than a member of your household or a person that you directly supervise as part of your career or employment. You may not give access to your account to any third party on-line service, including but not limited to any mileage management service, mileage tracking service, or mileage aggregation service. You must access your account information directly through the Site and not through a third-party Web site, including but not limited to any mileage management service, mileage tracking service, or mileage aggregation service.

• Distribute, disseminate, post, or publish any information or material that degrades, embarrasses, harasses, humiliates, intimidates, or threatens any individual or group of individuals on the basis of their age, ancestry, color, ethnicity, marital status, medical condition, mental or physical disability, national origin, race, sex, sexual orientation, union or nonunion affiliation, or any other basis protected by federal, state, or local law or ordinance.


• Abuse, defame, harass, stalk, threaten, or otherwise violate others legal rights, including but not limited to rights of privacy and publicity.


• Download or upload files that may damage the operation of another's computer, such as computer viruses, corrupt files, or similar software.


• Download or upload files that contain materials, including but not limited to software that violate the intellectual property, privacy, or publicity rights of others unless you own, control, or have been authorized to exercise such rights.


• Misrepresent or omit the origin or source of any file you download or upload.


• Download or upload files that do not contain the posted proprietary language, author attributions, and/or copyright, patent, or trademark notices.


• Distribute, disseminate, post, or publish any indecent, infringing, obscene, or unlawful information or material.


• Engage in any commercial purpose including but not limited to the following:

1. Advertising or offering to sell any goods or services.
2. Conducting contests or surveys.
3. Distributing chain letters, or advertising with respect to any Ponzi scheme or pyramid scheme.
4. Advertising or offering to sell any business opportunities, direct-sales opportunities, employment, independent contractor positions, multi-level marketing opportunities, or securities.


• Post, send, or otherwise disclose confidential information, trade secrets, or other confidential and/or protected proprietary data of any entity or person, including but not limited to ALMA DE MEXICO or any of its affiliates.


• Download or upload files that you know, or reasonably should know, cannot be legally distributed through the Site.


• Copy or create derivative works from, display, distribute, license, perform, publish, recreate, reproduce, sell, transfer, or transmit any information, products, services, or software obtained by, from, or through the Site.


• Monitor or copy any Content by using any manual process, or any robot, spider, or other automatic device, without first obtaining written consent from ALMA DE MEXICO.


• Act as an agent or attorney in fact for any person who is not one of the following:

1. A member of your immediate household.
2. Your direct supervisor at your place of employment.


• Take any action that will or could impose an unreasonable or disproportionately large load on our site infrastructure.
  
  
• Engage in any other conduct that is, or that ALMA DE MEXICO deems to be, in conflict with this Agreement.
  
  
• ALMA DE MEXICO forbids such Misuses, and access of the Site for any such Misuses or other similar purposes is an unauthorized use of the Site.

• ALMA DE MEXICO makes no representations or warranties as to the Content's completeness or accuracy, and makes no commitment to update the Content. ALMA DE MEXICO makes no representations about the Content's suitability for any purpose.


• YOU USE THE SITE AT YOUR OWN RISK. • ALMA DE MEXICO neither warrants nor represents that your use of information and material on the Site will not infringe upon the intellectual property rights of third parties.


• ALMA DE MEXICO shall not be liable for any virus or other damage to your computer equipment or other property due to your accessing, browsing, or using the Site or due to your downloading any audio, data, images, materials, pictures, text or video from the Site.


• A reference to goods, products, and/or services without limiting their geographic scope does not imply that ALMA DE MEXICO offers or intends to offer those goods, products, and/or services in all locations.

• ALMA DE MEXICO specifically denies you permission to hyperlink or provide references to the Site, unless you are allowed to do so under a separate written agreement with ALMA DE MEXICO.


• You are also denied permission to use any trademarked or copyrighted material to provide such hyperlinks or references, unless you are allowed to do so under a separate written agreement with ALMA DE MEXICO.


• ALMA DE MEXICO bears no responsibility for sites that provide hyperlinks or references to the Site unless those sites are operated by ALMA DE MEXICO.

• We will communicate with you via e-mail; you accept that all agreements, notices, distributions and other communications that we send electronically satisfy the legal requirements that such communications be in writing.

• Air transportation is subject to the terms of individual contracts (that include rules, regulations, rates and conditions) of the air transportation companies. These contracts are incorporated for reference in each ticket emitted and they form part of the contract of transportation. The incorporated terms may include, but are not limited to, the following:
  
  1. Limitation of responsibility for personal injury and/or death.
  2. Limitation of responsibility for luggage that includes fragile goods or perishables and the availability of coverage for excessive evaluation.
  3. Restrictions of claims, which include the periods in which the passengers must present a claim or initiate a legal process against the carrier.
  4.Rights of the air carrier to change the terms of the contract.
  5. Rules for the reconfirmation of reservations, times for booking of passengers and the refusal of the transportation service.
  6. Rights of the air carrier and limits of responsibility for delays or the impossibility of providing the service, including changes in schedules, the substitution of air carriers or alternate equipment, and redesign of the route.
  
  
• You have the right to review all the text of each one of the rules of the air carriers that provide the service at the airport and the ticket offices in the city.
  
  
• You also have the right, when you so request it, to receive all the text of the applicable terms, free of charge, incorporated for reference from each of the air carriers that provides the service.
  

• All amounts shown on Aerolineas Mesoamericanas alma.com.mx are expressed in Mexican Pesos (MXN) and/or American Dollars (USD) except when otherwise noted. The denomination appears clearly expressed in each product or service.

For your security, ALMA DE MEXICO requires that all passengers present an official identification or document of identification (birth certificate or school ID for those that are under age) to be able to travel. The acceptable forms of valid identification are the following:

• Voting credential with photograph (IFE)


• Valid passport


• National Military Service Card


• Visa


• Student ID

• It is suggested that you have identification without distinction because it will be required by some airports (school ID with photograph, copy of birth certificate or passport, valid or expired).

• The airline’s flights may be overbooked and it is possible that there is no available seat on a flight when a person has a confirmed reservation.
  
  
• If the flight is overbooked, no one will be denied a seat until the airline personnel first ask for volunteers who are willing to give up their seats in exchange for a compensation of the airline’s choosing.
  
  
• If a sufficient number of volunteers are not obtained, the airline may deny boarding to other people according to their boarding priorities. With few exceptions, compensation will be provided to those people who were denied boarding involuntarily.
  
  
• The complete rules for the payment of compensation and the boarding priorities of each airline are available in all of the airport ticket counters and places of boarding.
  

Domestic flights - Notice of limitations of responsibility for luggage.

Flights made completely within the Mexican Republic:

• Responsibility for lost or damaged luggage is limited to up to 75 days of minimum wage of the locality where the transportation service incident occurred.


• No responsibility for electronic equipment, photographic equipment, jewelry, cash, computer equipment or other articles of similar value.


• Damaged luggage must be reported within 24 hours of having received it.

• ALMA DE MEXICO is an airline that does not permit smoking on its flights.


• The use of tobacco products is prohibited in the whole system of flights that ALMA DE MEXICO operates.

• This Agreement constitutes the entire agreement governing your access to, dealings with, and use of the Site. Of course, separate agreements may attach to any goods, products, or services you obtain, purchase, or use from the Site.


• Any failure of ALMA DE MEXICO to assert any rights it may have under this Agreement does not constitute a waiver of its right to assert the same or any other right at any other time or against any other person or entity.


• If any provision of this Agreement is found to be invalid or unenforceable, the invalid or unenforceable provision will be stricken from this Agreement without affecting the validity or enforceability of any other provision.

• Any controversy that relates in any way to the visit to alma.com.mx or to the products you acquire through alma.com.mx will be subject to the jurisdiction of the Primer Partido Judicial del Estado de Jalisco courts, located in the city of Guadalajara, Jalisco.

• At ALMA DE MEXICO we respect the right to privacy on the Internet and we are committed to protecting your personal information. This document describes the manner in which we protect the information you provide on alma.com.mx.


• By using alma.com.mx, you accept the practices described in these Privacy Policies.

• ALMA DE MEXICO alma.com.mx offers security for information of credit cards, names, addresses, e-mail addresses and any other personal information that the visitors may provide within the Reservations, Purchases, Changes and Cancellations, My Reservations and My Profile sections of our site. We protect the personal identity information of our visitors by means of the use of industry standard practices.


• Currently, our pages use diverse measures of security designed to protect personal identification information from unauthorized access by users inside and outside of ALMA DE MEXICO alma.com.mx,certified by Verisign. We treat information as an asset that must be protected against loss and unauthorized access. • The data obtained by ALMA DE MEXICO alma.com.mx is a company asset. It is possible that ALMA DE MEXICO, its subsidiaries, affiliates or any combination of the previous, may be merged with another company or be acquired by another company. alma.com.mx does not sell products to minors. We sell products for minors that can be purchased by adults. If someone under 18 years of age wishes to purchase a product or service, they can use alma.com.mx only with the supervision of a parent or guardian.

• We only send promotional messages via e-mail if you have voluntarily provided us with your e-mail address and asked us to do so.

• You are responsible for all actions that are made using your User Identification and password, including charges that are made to your account.
